TERMS OF USE

1. ACCEPTANCE OF TERMS
These Terms of Use (“Terms”) govern your access to and use of www.sosassistance.us and related services.
Use of our services is also subject to our Service Terms & Conditions available at www.sosassistance.us/service-terms.
By accessing or using the Site and Services, you agree to be bound by these Terms. You must be at least eighteen (18) years old.
2. SERVICES AND INDEPENDENT CONTRACTORS
SOS Assistance provides property maintenance and related services through employees and/or independent contractors.
Independent contractors are not employees or agents of SOS Assistance and control the manner and method of their work.
3. DISCLAIMER OF WARRANTIES
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SOS ASSISTANCE DISCLAIMS ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
4. LIMITATION OF LIABILITY
SOS ASSISTANCE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
5. PAYMENTS AND BILLING
SOS Assistance accepts payment through credit/debit cards processed by third-party PCI-compliant payment processors (such as Stripe), electronic transfer platforms (including Zelle and Venmo), and by check.
For card payments, SOS Assistance does not store full credit card numbers on its servers. Card data is processed securely by third-party providers.
For electronic transfers (including Zelle and Venmo), customers are responsible for ensuring that payments are sent to the correct recipient information provided by SOS Assistance. Electronic transfers are considered final once confirmed.
For payments made by check, services may be delayed or suspended in the event of insufficient funds. Returned checks may be subject to additional fees as permitted by law.
By submitting payment, you represent and warrant that you are authorized to use the selected payment method. SOS Assistance reserves the right to refuse or cancel transactions suspected of fraud or unauthorized activity.
Improper chargebacks or disputes initiated without valid basis may result in suspension of services, recovery efforts, and legal remedies where permitted by law.
6. DISPUTE RESOLUTION
Disputes shall be resolved by binding arbitration in Florida or Texas depending on where services were performed. Class actions and jury trials are waived.
7. GOVERNING LAW
Florida law governs services performed in Florida; Texas law governs services performed in Texas.
